DOMESTIC ORDERS (ITALY)

We normally ship directly to the Customer's home via the postal service. We will ship to a workplace or barracks in the event of:

  1. a request
  2. the purchase of two complete institutional
  3. specific cases which shall be assessed by La Griffe for security reasons. (In that case, the purchaser shall be aware of the shipping address)

We cannot ship to post office boxes. The cost of handling, packaging and domestic shipment (Italy) is €8.90 inc. VAT, except where the total order value is more than €79.00. In this case, and only for shipments within Italy, shipping is free-of-charge.

Received orders are usually prepared and shipped by us within 24-48 hours.  When we begin preparing your package, we will send you an email containing information about the delivery and our shipping company will send you an email or text message containing a link with which you can track your order online. You can check the progress of your order in "Orders" after logging in to "My Forcetek".

Our shipping company usually delivers domestic orders (Italy) within 24-48 hours. Experience has shown us that deliveries to remote areas or islands requires an extra 1-2 days. To get your order to you as quickly as possible and without incident, our shipping partner requires a telephone number on which you can be contacted during the day, or for rescheduling delivery (see field in shopping cart). Moreover, it would be useful if you could provide a delivery address at which you or a trusted person are usually available. Orders will only be despatched if all previous orders have been paid for and they remain the property of La Griffe srl until full payment is made. If we are unable to deliver the package, it will be returned immediately to La Griffe srl. If the shipping company is unable to deliver a package, this will be delivered to the nearest post office to await collection.

Deliveries to countries outside the EU are made only with prior agreement (except for Switzerland). In this case, please contact us at shop@forcetek.it. Shipping within Italy is free-of-charge for orders over €79.90. Otherwise, shipping is charged at €8.90 inc. VAT.

Received orders are usually prepared and shipped by us within 24-48 hours. Our shipping partner undertakes to deliver anywhere in the European Union within 2-5 days. Experience has shown us that deliveries to remote areas or islands requires an extra 1-2 days. Delivery to Switzerland takes around 10 days.

To get your order to you as quickly as possible and without incident, our shipping partner requires a telephone number on which you can be contacted during the day (see field in shopping cart). Moreover, it would be useful if you could provide a delivery address at which you or a trusted person are usually available. Orders will only be despatched if all previous orders have been paid for. Products remain the property of La Griffe srl until full payment is made.

DELIVERY DELAYS AND LACK OF AVAILABILITY OF GOODS

This online shop is directly connected to our logistics software. We can therefore provide you with immediate availability of each individual item. In exceptional cases, however, it is possible that despatching delays can occur or that the requested products are not available. In such cases, we will inform you as a result without delay. We reserve the right to ship partial orders.

If the Customer is not available, the goods shall be deposited in the shipping company's local warehouse and, depending on the service provided, a second attempt may be made to deliver the items without them being held for collection.

At the end of this period, the package is returned to the Vendor, the contract is considered void, the order is cancelled according to the provisions of art. 1456 of the Italian Civil Code, and a new order will then have to placed.

With the contract cancelled, we will proceed to refund the sum paid by the Customer, after deduction of costs for shipment of the unsuccessful order, for return of the order to the Vendor, for storage, administration and order handling to the sum of €15.00.

Cancellation of the contract and the sum to be refunded shall be communicated to the Customer via email. The refund shall be made using the same payment method which the Customer used to pay for the order, after checks on the completeness of the returned product are made.

The Vendor cannot be held responsible for incorrect items being shipped due to errors or omissions made by the Customer when placing the Order (incomplete or incorrect address, incorrect telephone number, etc.).

The Vendor cannot be held responsible for any damage caused to products following handover of a shipment to a shipping company, including for delays to delivery which are the fault of the shipping company.

TRANSFER OF RISKS AND DAMAGE IN TRANSIT

The Vendor is relieved of its responsibility for loss or damage to products contained in the order from the moment the shipment is handed over to the shipping company. This does not affect your consumer rights if the loss or damage to the product is shown to be the fault of the shipping company. The Customer is responsible for care of the item during its return to the Vendor. In the event that a product is damaged or destroyed while it is in the Customer's care, the Customer shall be held responsible.

At the moment the goods are delivered, you are requested to check:

 

  1. a) that the number of packages delivered corresponds to that indicated on the despatch note (DDT)

 

  1. b) that the packaging is intact (not wet, pierced, folded or other)

Any exterior damage or inconsistency in the number of packages must be immediately notified in writing to the company which carried out the delivery, using the words "GOODS CHECK CLAIM for ... indicate reason)" on the appropriate accompanying document that the shipping company will require you to sign.

For example, you could write: "GOODS CHECK CLAIM for damaged parcel" or "GOODS CHECK CLAIM for non-delivery of a parcel", etc..

If you accept the product and sign the delivery note without making the necessary checks, you will not then be able to claim any missing items or damage caused in transport.

Any claims made in this way must be confirmed within seven (7) working days via a detailed email sent to: shop@forcetek.it

Having received the email from the Customer, the Vendor shall request that the shipping company opens a case for damage in transit.

Once a case of damage in transit has been acknowledged (the final decision remains with the shipping company), we will proceed to organise the repair of the product, order a replacement or refund the value of the product. Any additional transport costs are at the Customer's expense.

Any claims made after the deadline will not be considered.

The Customer takes full responsibility for the information declared in any claim.

In the case of a return, the Customer shall be responsible for any reduction in the value of the goods resulting from its handling other than that which is strictly necessary to establish the nature, specifications and function of the goods.

RIGHT TO CANCEL, RETURN AND EXCHANGE

RETURNS

You have the right to cancel the purchase contract within 14 days.

To return an item, you will need to access the returns section of your account, download and complete the form and send it by email to shop@forcetek.it. Please wait for a reply from us and if successful, follow the instructions contained in the email reply. Please indicate the reason for the return to allow us to improve our service and proceed with the refund. The right to cancel the contract starts on the date the goods were delivered. Cancelling the contract is not possible if the goods have been damaged in any way by the Customer (e.g. goods are dirty, etc.). Please do not remove any labels from the goods if you are not certain you want to keep them.

Returns are free-of-charge in Italy and the price of the product will be refunded accordingly.

WARNING! The cost of shipping the product back to us is at the Customer's expense. We recommend using a tracked shipping service so you can check the progress of the shipment. We are not responsible for mistakes made when shipping the goods or damage caused by the shipping company.

Returned items must be complete, undamaged and unused, with labels, tags and original packaging.

Refunds will be made within 30 days of arrival of the product into our warehouse and shall be made using the same method used for payment. After having received the parcel containing returned items into our warehouse, we will send you a notification of cancellation via email with confirmation of receipt of the parcel and credit note for the price of the returned product. Should the returned item turn out to be damaged, the amount to be refunded will vary depending on the extent of the damage.

If you paid using a credit or debit card, we will refund the amount to the same card used for the purchase. If you paid via PayPal, we will credit the amount to your PayPal account.

We reserve the right to accept cancellation of the contract only if the goods have been returned in their original state (including original and shipping packaging).

EXCHANGE

If you need to exchange your item for a different size, complete the form using the correct return code and the size you now require. Follow the instructions and as soon as we receive the product to be exchanged (and examined it), we will send you the new size you indicated.

Warning! You can make one exchange per product. Return shipping is the responsibility of the Customer. We will then send you the correct size you indicated at our expense. We recommend using a tracked shipping service so you can check the progress of the shipment. We are not responsible for mistakes made when shipping the goods or damage caused by the shipping company.

 

INSTRUCTIONS FOR RETURNS

To return/exchange a product, follow these instructions:

Inside your parcel you will find instructions on how to make a return, but if you have lost the sheet, please see below:

  1. Access the returns section of your account, download and complete the form and send it by email to shop@forcetek.it.
  2. Wait for our reply
  3. If accepted, you will receive an email within a few days containing the address to send the return/exchange item to.
  4. Send the item (items must be complete, undamaged and unused, with labels, tags and original packaging). Ensure that you use a tracked shipment service because we can't process a refund if we don't receive the parcel.
  5. As soon as the return is received and processed, we will proceed to make the refund. In the case of an exchange, we will send you the indicated new size at no extra cost.

WHO DO I RETURN IT TO?

If you have sent the completed form and it is accepted, you will receive an email within a few days containing the address to send the return/exchange item to. If you have lost the email, please request a new one from customer services.

PAYMENT/MINIMUM ORDER VALUE/PRICING

PAYMENT

You can choose to pay for your Forcetek purchase with:

  1. a) credit card  
  • We accept credit cards carrying the Mastercard or Visa symbol.
  • All transactions are encrypted for your security*.
  • The purchase amount will only be debited the moment your order is shipped**.

* Forcetek guarantees maximum security for your data. All information is sent over an encrypted channel to guarantee that your sensitive data is totally secure.

** If the credit card transaction is authorised, the amount will be reserved immediately and you will receive confirmation of your order by email. The purchase amount will only be debited the moment your order is shipped. If you return one or more items, the corresponding amount will be refunded to your card, after deduction of €15.00 inc. VAT for administration and handling costs. If the credit card transaction is not authorised, your order will be cancelled. Contact your bank for card provider if you have any questions in this regard.

PRICING

Customers belonging to these categories: Army, Police, Fire Brigade, Carabinieri, Guardia di Finanza and Air Force benefit from special pricing for the purchase of institutional products, displayed after registration, and a discount for all others. In principle, all prices apply at the moment the order is placed. Unless otherwise indicated, prices refer to the items displayed in each case according to the description. However, they do not refer to their contents, accessories and/or decorations. Mistakes and price variations excluded. All prices are final and include the current rate of VAT applicable in Italy. Shipping costs are not included in the prices shown. Please refer to the appropriate table for shipping costs. Until further notice, we will proceed according to the "country of origin principle" which means we will apply the VAT rate applicable in the country of origin (Italy) for purchases within the EU.

LEGAL GUARANTEE OF PRODUCT COMPLIANCE

Each Product sold on the Site to a private Consumer benefits from a Legal Guarantee of Compliance pursuant to art. 128 and sub.of Leg. Dec. No. 206/2005. Therefore, the Vendor is responsible to the Consumer for any non-compliance which exists at the moment the product is delivered and which appears within two (2) years of the aforementioned delivery. Any cases of non-compliance must be declared to the Vendor within two (2) months of the date of discovery, or the guarantee shall be void.

A purchased product is considered non-compliant if it:

 

  1. a) is not fit for the purpose usually destined for products of its type

 

  1. b) does not comply with the description provided by the Vendor and does not possess the qualities the Vendor presented to the Consumer as a sample or model

 

  1. c) does not possess the qualities or features normally expected of a product of its type, or that the consumer could reasonably expect of it, given also any declarations made about it in publicity or on its labelling

 

  1. d) is not fit for the purpose the consumer particularly required of it and where this was brought to the attention of the Vendor at the moment the contract was agreed and which the Vendor also accepted as evidence

Unless proven otherwise, it is presumed that the non-compliance which appeared within six (6) months of delivery of the Product already existed on this date, unless this theory is incompatible with the nature of the Product or the nature of the reason for non-compliance. Starting from the seventh month following delivery of the Product, it will be the responsibility of the Consumer to prove that the case of non-compliance already existed at the moment it was delivered.

Products which have been repaired, modified or otherwise altered by the Consumer are also excluded from the legal guarantee of compliance.

In the event that a case of non-compliance is duly declared within the time limits, the Consumer has the right to:

 

  1. a) in the first instance: the choice of repair or exchange of the Product free-of-charge, except where the requested remedy is objectively impossible or excessively costly for the Vendor compared to the other and, therefore, in this specific case, given the type of sale, substitution of the Product where this is possible within available stocks for sale

 

  1. b) in the second instance: the choice of a reduction in the sale price or cancellation of the contract. However, this is in the event that repair or replacement is impossible or excessively costly, or if repair or replacement is not concluded within an acceptable timeframe or a previously concluded repair or replacement has caused significant inconvenience to the Consumer.

The requested remedy is excessively costly if it involves the Vendor in unreasonable expenditure compared to alternative remedies which could be tried, given (I) the value that the Product would have were it compliant; (II) the extent of the non-conformity; (III) the possibility that an alternative remedy might be tried without causing significant inconvenience to the Consumer.

The Vendor cannot be held responsible in any case where its failure to comply with any of obligations under these General Terms & Conditions of Sale is caused by events beyond its control and/or force majeure.

USE OF THE SITE

The photographs and videos used to display the Products next to the descriptions are published on the Site for information purposes only, given that the quality of images, including an exact representation of colour variants, can depend on the software and computer devices used by the Customer when viewing the Site itself. The Vendor accepts no responsibility for problems experienced by the Customer when using the Site and for any technology used as this is completely beyond its control.

 

PROTECTION OF PERSONAL DATA

The Vendor is the holder of personal data collected at the time of a user's registration on the Site, and of any subsequently communicated at the time of purchase by the Customer. Excluded from this is data relating to the payment procedure for which the Customer is transferred to banking institutions for the purpose of processing the transaction. For information relating to the processing of personal data, please refer to the "Privacy Policy" displayed on our website.

 

LIABILITY WAIVER IN THE EVENT OF FORCE MAJEURE

The Vendor cannot be held responsible in any case where its failure to comply with any of obligations under these General Terms & Conditions of Sale is caused by events beyond its control and/or force majeure, including, and purely as examples, natural disasters, acts of terrorism, electricity supply problems and/or blackouts.

 

APPLICABLE LAW AND COMPETENT JURISDICTION

This Contract of Sale between the Customer and the Vendor is stated on our Italian-language website and is governed by Italian Law.

Where the user is either a professional or a company, for any disputes deriving from the interpretation or execution of this contract, the Courts of Law of Ascoli Piceno shall have exclusive legal jurisdiction.

If the problem was not resolved by contacting us via email at shop@forcetek.it, you can submit your complaint to the EU's online dispute resolution platform ("ODR").

The ODR platform offers consumers and professionals in the EU the ability to reach an extra-judicial solution for complaints relating to online purchases. This input-only website is designed to be interactive and easily understood, available in all official EU languages and free to use. By using the ODR platform, consumers and professionals can turn to a given organisation which will seek to find a solution to the dispute. MISCELLANEOUS

These General Terms & Conditions of Sale define the terms and conditions which apply to the Customer/Consumer at the moment the sale of Products listed on the website is made.
