DEFINITIONS
In these General Terms & Conditions of Sale:
a) "Customer" refers to the person or individual who purchases products from www. forcetek.it
b) "Consumer Code" refers to Italian Legislative Decree No. 206/2005 as modified by Leg. Dec. No. 21/2014, which constitutes the set of regulations governing consumer rights and transposes into Italian law European Directive 2011/83/EU which amends Directives 93/13/EEC and 1999/44/EC
c) "General Terms & Conditions of Sale" are the terms governing sale and purchase of products via the website www.forcetek.it
d) "Consumer" according to the terms of art. 3 para. a) of the Consumer Code means "any physical person not acting on behalf of any corporate or business activities";
e) "Contract" refers to the contract of sale concluded between the Vendor and the Customer whose purpose is the sale of products on the website www.forcetek.it
f) "Legal guarantee of compliance" refers to the Guarantee provided for in arts. 128-135 of the Consumer Code, applying exclusively to Consumers.
g) "Order" refers to a request from the Customer to the Vendor to purchase a product listed on the website www.forcetek.it
h) "Product or Products" refer to all the products sold from time to time via the website www.forcetek.it
i) "Purchase Offer" refers to the written confirmation whereby the Customer communicates to the Vendor their intention to purchase a product listed on the website www.forcetek.it

PURCHASE AGREEMENT
For orders placed on www.forcetek.it, the purchaser's contracting partner is:

The representation of products in our online shop does not constitute a binding proposal; this is solely a non-binding online catalogue. By clicking on the button marked "Place Order", you are placing a binding order for the products in your shopping cart. A confirmation of receipt of your order along with acceptance of your order happens immediately after the order is made via the display of a confirmation of your order and via an automated email which is sent containing a copy of the order. The purchase contract comes into effect when the above confirmation is displayed. We reserve the right, in exceptional cases (e.g. due to a product being unavailable), to choose whether to:
a) cancel the Order and reimburse any monies already paid;
b) substitute the Product;
c) wait longer than the prescribed time
In the event that we choose the solution mentioned in point a), reimbursement of any monies paid shall be made as quickly as possible and in any case within thirty (30) days from the date that notification of a request for reimbursement is received.
By placing an order, you declare automatically that you have read all the information provided during the process of making the purchase and that you accept all of the General Terms & Conditions of Sale and payment terms indicated herein.
The Vendor cannot be held responsible for incorrect items being shipped due to errors or omissions made by the Customer when placing the Order. The Vendor cannot be held responsible for any damage caused to products following handover of a shipment to a shipping company, including for delays to delivery which are the fault of the shipping company.
3. CUSTOMER SERVICES
Despite all the checks we make on our products, if you should be in receipt of defective or damaged goods, please complete the form available on the returns page of your account.
4. WARRANTY
The legal warranty period of 24 months applies to new products in all countries of the European Union. Please use the paper form if you wish to make a claim against this warranty.
5. ACCOMPANYING DOCUMENTATION
Pursuant to article 1 paragraph 1 of the Ministerial Decree of 21/12/1992, distance sales are exempt from issuance of tax documentation (tax receipt, invoice and similar documents). You will receive from us an accompanying document containing all the information relating to your order (order number, purchaser's details, list of items ordered, their quantity and value, total order value, shipment and payment information, etc.). Please keep these accompanying documents. They constitute important proof of your purchase in the event of a problem.
7. COPYRIGHT
The entire contents of the websites www.forcetek.it and www.lagriffe.com are the exclusive property of La Griffe srl and are therefore protected by copyright. No part of this content may be reproduced, processed, duplicated or transmitted by electronic systems in any way without explicit written permission from La Griffe srl. All rights reserved. Warning: the theft of copyrighted content will be subject to criminal prosecution. We reserve the right to legally protect our rights in these matters.
8. LANGUAGES
The site is in Italian and English. Your purchase contract shall be concluded in Italian.
9. PURCHASE PROCEDURE
Only products displayed on the website at the address www.forcetek.it at the time the order is placed, and as described in the relative information sheets can be purchased. Please be aware that the image placed next to the description of a product may not be an exact representation of its specifications: measurements, shapes and colours may differ from that shown in the photograph and in the description, without compromising its look, function and quality.
Products aimed at state institutions such as Army, Police, Carabinieri, Fire Brigade, Guardia di Finanza and Air Force may be purchased only after registration and identification via mail including official ID attesting that the purchaser is currently engaged by one of the aforementioned state institutions and for these products they will benefit from individual pricing.
If the customer is interested in some particular features of a product, it is the customer's responsibility to contact us before placing the Order to ensure that the chosen product actually possesses those features.
Successful receipt of an order is confirmed by the Vendor to the Customer via an email sent to the email address provided by the Customer at the time of purchase. This confirmation email shall include:
a) all details entered by the Customer (name, surname, address, email address, etc.);
b) date order was received;
c) Product description (specifications, colour, dimensions, price, etc.)
d) "Order Number" to be quoted in any later correspondence with the Vendor;
The Customer must then verify the accuracy of their order and communicate any inaccuracies immediately in writing to shop@forcetek.it
You can check the progress of your Order by accessing your Account and going to "My Orders"
Orders may be cancelled up to the moment the Customer receives the email stating that the item has been shipped. We will deduct 10% of the order price to cover administrative, logistics and operating costs.
An Order cannot be cancelled or modified for any reason whatsoever once it is marked "Shipped". Your Right to Cancel notwithstanding, orders for custom or bespoke products can NEVER be cancelled.
Once an order has been received, we will check it to ensure it is acceptable. In the event that it is not accepted, we will communicate this immediately to the Customer. All prices quoted on the website are intended as public prices and therefore include VAT, except where the chosen destination country lies outside the EU.
By purchasing one or more items belonging to the Esercito, Polizia, Carabinieri, Vigili del Fuoco, Guardia di Finanza and Aeronautica ranges, the purchaser takes full responsibility for the purchased items and the purpose for which they are destined. Where two complete sets are purchased, delivery will be made to a place of work.
